Third-party proceedings of priority: a misunderstood remedy?

Abstract

The paper analyzes and criticizes the criterion assumed by the Peruvian jurisprudence that requires for the admission of a claim of preferential right that the credit of the third party is determined in a “previous process”. This position not only lacks any legal basis, but entails ignoring the role of the Third-party proceedings of priori-ty in the system, as remedy to prevent them damages that enforcement can cause to third creditors. Is in such process where should be discussed not only the priority of the credit but also the own existence of the credit.
