Los convenios de estabilidad jurídica como mecanismos para promover inversiones en la industria minera

Abstract

En el presente artículo los autores examinan el rol del Estado como promotor de la inversión en el sector minero en el país a través del otorgamiento de garantías de estabilidad jurídica. Para ello analizan tanto el régimen de estabilidad para la inversión en actividades mineras como el régimen general. Además, realizan una comparación entre las medidas de promoción de la inversión en la industria minera existentes en el Perú frente a las existentes  en otros países de la región. Finalmente, revisan el proyecto de ley propone la modificación de la actual regulación de los contratos de estabilidad tributaria para la minería.

On this paper, the authors examine the Government’s role as promoter of the investment on the mining industry through the granting of guaranties of legal stability. In doing so, the authors analyze both the stability regime for mining investments and the stability regime for regular investments. Also, they make a comparison between the measures for promoting investment on the mining industry in Peru against the existing ones on other countries in the region. Finally, they review the bill of law that proposes the modification of the present regulation of the tax stability agreements for the mining industry.
