Abstract

The paper analyzes the various existing systems on the subjective scope of the sentence issued in a collective process, showing their preference for the pro et contra with the option of opt out for the effects of the res judicata. Likewise, it is argued that the theory of the burden dynamic of the proof may represent a solution to the fact that the plaintiffs of the collective group may be affected by a poor procedural strategy in the first process where an unfavorable judgment was obtained.
