Abstract

In the present work, the author, starting from the premise that the legitimated extraordinary, in the collective processes, acts as an appropriate representative of the class making the defense all interests of the members, as if they had been present, analyzes the various systems in the field of the collective res judicata, arguing that the best system that meets the interests, needs and rights of all participants is the bilateral preclusion as well as it operates in the federal law of the United States of America.
