Abstract

The work develops the most important aspects of the theory of procedural nullity, and the legal rules that the doctrine been established in this regard, and the treatment that has this juridical institution in the new Criminal Procedure Code Peruvian of 2004, to the purpose of establishing the scope of the power to declare the nullity having the reviewing body of the second instance –even ex officio–, when this get to known of an appeal and the corrective faculties that are also attributed to this judicial court.
