"Judiciary Branches", process and judicial policy: a view through the Constitutional State´s lens

The author maintains that the unitary judicial function in Peru entails that only the State has the power to resolve conflicts, which does not prevent it from being exercised by anyone authorized by the Constitution ("Judiciary Branches"). This thesis runs parallel to another: on one hand, in the Constitutional State it is possible to speak about the Public Service of Justice and no longer of the Admin-istration of Justice, since the citizen is the main character; and on the other hand, it is important to refocus on the judicial policy in regard to the process, given its role as an essential instru-ment in the provision of the service.Downloads
