Limits of contempt of court in comparative law and its regulation in Peru

Abstract

This work is focused in analyzing some foreign legal frameworks concerning the parameters and limits that a judge has when determining the quantum of compulsory measures, in their condition as indirect execution measures. Then, it is verified if exist limits that have been expressly or tacitly included by the Peruvian Code of Civil Procedure or, on the contrary, if such regulation appears to be insufficient. In that way, it is analyzed if the Project of the new Peruvian Civil Procedure Code in order to determine if it contains novelties comparing to the current legal framework. Finally, as a conclusion, we shall present some ideas about the discipline of the limits of compulsory measures in Peru.
