Abstract

The article discusses the covenant not to sue in Brazilian Law. Examining its origins in the pactum de non petendo in Roman Law and in the classic and comparative jurisprudence, the author approaches to the debate on the object, nature and effects of such litigation agreement. Also, it is intended to identify the existence of species of not to sue agreements in in statutory provisions and in judicial practice of the Brazilian legal system.
