Principles, Rules, and Systems: Towards a Malleable Procedure

The author argues that the adaptability of forms is a mixed variant between the systems of legal formalism and informalism, and not strictly a guiding principle of the process. Thus, if incorporated into procedural systems, it would serve as a tool for the judge to better perform their creative and remedial functions in the process.
