Abstract

This article is a translation of a classic text by Salvatore Satta, which offers a critical reflection on the discontinuance of proceedings under the Italian legislation of his time. The author emphasizes the tension between the judge's power to terminate the process, which can foster an authoritarian stance, and the dispositive principle of procedure, whereby the continuation of a case remains subject to the interest of the parties.
