Abstract

This article engages in dialogue with a text by Sergio Chiarloni on the functions of Supreme Courts. It focuses on the observation that decisions of Supreme Courts possess normative force and, therefore, must be harmonized and complied with. With specific reference to Brazilian law, the article discusses the system of precedents introduced by the 2015 Code and the ways in which precedents are binding, which are not limited to the ratio decidendi.
