Thinking About the Organic Structure of the Constitutional Court

The work shows the organizational setup of the Constitutional Court in the last two Constitutions of Peru (1979-1993). This analysis is performed in parallel, highlighting the advantages of the Constitution of 1979, not only as to the way the judges are selected, but also in their number and term of office. The author concludes his analysis by questioning the method of selecting judges of the highest constitutional court in the recent experience, task that has finally been committed to the spokespersons of political parties. Thus, the author believes that not only participation of the other branches of government -which were responsible for proposing candidates according to the text of 1979- would be relegated, but also civil society as a whole.Downloads
