Abstract

The article presents one of the most outstanding aspects of the recent Law No. 21,121, published on November 20, 2018, which is the introduction in the Chilean Penal Code of the new offense of disloyal administration. In first place, the reform of Law No. 21,121 is introduced, highlighting the place of the new offense of disloyal administration in it. Later, the absence of a general criminal type of disloyal administration in our environment prior to the reform is exposed, analyzing succinctly how this absence was addressed by the doctrine and jurisprudence. Third, the main changes of the criminal description between its origin and the text that was finally approved are reviewed. Then, an analysis of the main elements of the crime is made, to finish exposing the main conclusions in relation to the new crime.
