Relations between preventive detention and punishment in expectation. The meaning of predictions and precisions
Keywords:
Pretrial detention, prediction, penalty to be imposedAbstract
In the present work we will seek to provide elements from the sociology of criminal justice for a better understanding of the use of pretrial detention in the Province of Buenos Aires, Argentina. In this sense, we will propose two main axes: one linked to the importance of predictions in the decision on this precautionary measure, taking into account how judicial actors elaborate such predictions. The second axis will be oriented to explore how in practice the penalty to be imposed, it becomes a central component in the application of pretrial detention.
