Publication Ethics

CHAPTER 1: Scope of Application

This Publishing Ethics targets all those involved in the editorial process (reception, peer review, correction of style and content, etc.). which concludes with the production of the biannual journal 'Law and & Society' - hereinafter, the Journal. It is mainly intended for the Editorial and Technical Board; authors who submit their paper in order to be published in the Journal; and peer review reviewers or arbitrators.

CHAPTER II: Aims of Publishing Ethics

The purpose of the Publishing Ethics is to promote the use of good ethical practices during our editorial process. Thereby, it is intended to avoid falling into bad behaviors that harm the scientific community and society. Moreover, it seeks to establish the appropriate guidelines to be followed in case there are ethical violations or conflicts of interest during the editorial process of our Journal.

CHAPTER III: Rights of the parties

Article 1. - Rights of the Editorial Corps and Technical Equipment

-   Right to editorial freedom.- The right to accept or reject the academic paper for publication in the Journal. This decision should be based on objective and well-founded causes.

-   Right to standardize the text submitted in accordance with the rules of style and content used by the Journal; as well as to suggest partial modifications to its contents if proposed by the arbitrators.

-   The right to proportionally adopt the necessary measures in the event of a case of supervening conflict of interest or an ethical complaint.

-   Right of first publication of the paper submitted to our institution.

Article 2. - Authors' rights

-    Copyright.- Considered as the right that gives you the prerogative to decide on the fate of the text submitted for publication in our Journal. At any time, you can withdraw from the publication in our journal and change the destination of the publication.

-    (Right to notify the modification of the text in case of identifying any significant error).

-    Right of defense in the event of any allegation of a conflict of interest or ethical complaint.

    - The right to know the reasons for which the sanction was issued, as well as the proportionality and reasonableness of the sanction.

Article 3. - Arbitrators' rights

-    Right to withdraw from their position as arbitrators in case they find a conflict of interest at the time of performing their work; or in case they are not specialists in the subject matter.

-    Right of defense in the event of any allegation of a conflict of interest or ethical complaint.

-    The right to know the reasons for which the sanction was issued, as well as the proportionality and reasonableness of the sanction.

-    (Right to request an extension in case they need an extension of the deadline that was agreed upon in the first place for the submission of the revision of the paper).

-    The right to know the result of the arbitration process of the paper they reviewed.

CHAPTER IV: Commitments of the parties

Article 1. - Commitments and obligations of the Editorial and Technical Board:

-    To guarantee the confidentiality of the evaluation process: during the editorial process, anonymity will be maintained between the referees and the authors. As well as with people outside the editorial or technical board.

-    Selection of the best papers: The Editorial Committee is committed to avoiding publication biases such as preference for the editor's line of research.

-    The selection will be based on objective criteria, as well as on the academic opinion of the referees.

-    Select the most qualified reviewers: the referees who participate in the editorial process should be the most qualified and specialists according to the subject of the article to be published.

Article 2. - Commitments and obligations of the authors:

-    Originality: the papers submitted must be original in their entirety, in addition to being unpublished. This is why they should not be sent simultaneously to two journals.

-    Veracity of the data: the data presented in the papers must not be manufactured or altered in order to support the hypothesis of the research.

-    Correct cited from bibliographic sources: Do not quote sources without having previously consulted them.

* Do not omit bibliographic references that contradict the research itself.

* Avoid the quotation of exchange, that is, that which is made through an alliance between researchers to mention their ideas in their work, even though they are not related to the objective of the text.

* Avoid the excessive self-quotation.

* Plagiarism or self-plagiarism: it is the intentional or reckless copy of the ideas, words, or design of previous works, to present them as their own.

-    On the other hand, self-plagiarism refers to the unquoted of own papers published earlier.

-    Research segmentation: it is the decision to fragment a study in several parts so that they are published as more than one work.

-    Order the signature of authorship according to the level of responsibility and involvement in the paper: it aims to avoid "undeserved authorship," which consists of assigning an author without having made a substantial contribution.

-    Conflict of interest: these may be academic, personal, economic, political or commercial and must be declared at the time of sending your work. However, if the Editor deems it appropriate, the paper may be published in the journal.

Article 3.- Commitments of arbitrators:

-    Objectivity of the review: this should be carried out according to the criteria assigned in the Review Guide of the Journal 'Derecho & Sociedad' or through comments in the same text, seeking to improve the quality of academic work. In addition, they should be clear and accurate judgments and evaluations, leaving aside any bias.

-    Avoid reviewing the text if they are not specialists in the matter.

-    Respect for the times: the arbitrators must consider that this revision is part of the editorial process, so it is necessary to conform to the agreed deadlines or, otherwise, to require an extension.

-    Confidentiality: Each manuscript shall not be disclosed to external persons or discussed without the express consent of the editors.

-    Conflict of interest: if a case like this is presented, the arbitrator must refrain from reviewing the work, communicating in a timely manner to the person in charge of the Editorial or Technical Board.

CHAPTER V: From the procedure to be followed in case a conflict of interest or a complaint of ethical nature is detected.

Article 1.- Reported unethical conduct or conflicts of interest include, but are not limited to, the cases described in previous chapters.

Article 2.- The cases mentioned in the ethical rules to which the Association adheres are subject to the present procedure, in accordance with the Only final provision of this Publishing Ethics.

Article 3.- Any ethical infringement or conflict of interest by the authors or arbitrators shall be communicated to the Editor General of the Journal. It will also decide how the investigation should be carried out and may seek advice from different members of the Editorial or Technical Team.

Article 4.- During the investigation, no member of the Editorial or Technical Board may disclose information or data that are related to this procedure.

Article 5.- Later to the investigation, the offender will have a right to answer the imputations that should have been done to him in the denunciation, having in knowledge all the information that they could have discovered during the investigation.

Article 6.- Taking in consideration these allegations, the General Editor of the journal has the faculty to sanction, according to the gravity of the fact, the imputed one.

Any decision will have to be motivated in accordance with the principles of proportionality and reasonableness.

Article 7.- The sanctions that may be taken by the General Editor are the following:

Inform the author or reviewer by means of an e-mail detailing and explaining the inappropriate conduct. This report will be considered as a warning for the future. Definitive withdrawal of the publication of the Journal. Sending a report of the case and its outcome to a professional organization or higher authority for further investigation and action.

Article 8.- Having been slightly sanctioned by means of an e-mail report is considered as a recidivism if the same or a different conduct occurs again.

Article 9.- The General Editor shall inform the offender of the decision taken, as well as the reasons for the outcome.

FINAL DISPOSITION

ONE.- In unintended cases, the Journal subscribes as a reference to international standards regulated by international organizations such as the Ethics Committee in Publishing (COPE). As well as its flowgrams with procedures before certain unethical behaviors and to its ethical policies.

The Ethics Resource Package is also incorporated into Elsevier's publication (PERK), and the guidelines set out in the Singapore Declaration on Integrity in Research. On the other hand, it also serves as a reference to the San Francisco Declaration on the Evaluation of Research (DORA).
