Certain aspects of financial difficulties and insolvency of an EPC contractor

The article analyzes the risk of financial difficulties or insolvency of the EPC contractor in complex construction projects from a legal standpoint and considering a project finance structure. We review the consequences of such risk; the contractual mitigants available for the project with respect of EPC contract guarantees; payment to subcontractors and works and termination of the EPC contract and assignment of subcontracts. Finally, we deal with certain relevant considerations in case of the EPC contractor, collection of liquid security, payment to subcontractors and cross-border insolvency.
