La intervención estatal en la libertad sindical en América Latina : los planos orgánico y tutelar

Resumen

En el presente artículo, el autor busca analizar las diversas manifestaciones de la intervención estatal en los planos orgánico y tutelar de la libertad sindical. De esta manera, ahonda primero en ejemplos de cómo varias legislaciones latinoamericanas tratan la titularidad, tipología y registro sindical dentro de la libertad de constitución de este derecho, así como la injerencia que estas presentan en la supuesta libertad de reglamentación o autonomía. Por otro lado, señala el autor que la intervención del estado resulta siendo necesaria para dar garantías positivas dirigidas a proteger y facilitar el ejercicio efectivo en el campo tutelar.

In this paper, the author aims to analyze the different manifestations of state interventionism on trade union’s freedom of association whether in its organic or tutelary level. In that way, the author first addresses examples of how different Latin American legislations have approached the union’s holders, typology and affiliation issues, within the framework of freedom of association, as well as the interference this laws represent to trade union’s autonomy. Furthermore, the author notes that the state interventionism is still required to give positive assurance to protect and facilitate the effective exercise in the tutelary field
