¿Seguirán existiendo jueces en el futuro? : el razonamiento judicial y la inteligencia artificial

Resumen

El presente artículo aborda los límites y posibilidades de que en el futuro la función jurisdiccional sea ejercida por computadoras que poseen Inteligencia Artificial, ello mediante el uso de programas de computación denominados “sistemas expertos”. Siendo un área del Derecho que ha sido particularmente sensible a aceptar el uso de estas tecnologías, el autor comienza explicando que son la Inteligencia Artificial y un sistema experto. Alcanzado tal objetivo, se analiza los límites y posibilidades que tiene la aplicación de estas tecnologías en el campo del razonamiento jurídico, así como los primeros proyectos de “sistemas expertos jurídicos”. De esa forma, el autor concluye que si bien los jueces y demás operadores jurídicos no podrían ser desplazados por estos programas de computación, la utilización de estos últimos si pueden optimizar el ejercicio de la labor jurisdiccional en el futuro.

This article addresses the limits and possibilities that in future the judicial function is exercised by computers which possess Artificial Intelligence, through the use of a software called “expert system”. Since is an area of law in which legal professionals usually have rejected the idea of using these kinds of technologies, the author starts explaining what are an Artificial Intelligence and an “expert system”. Done that, he analyzes and studies the limits and possibilities of applying these technologies in the field of legal reasoning, as well as the first projects of “legal expert systems”. In this way, the author concludes that judges and other legal professionals couldn’t be displaced by using an “expert system”. Nevertheless, those legal expert systems could serve to optimize the exercise of the judicial work in the future.
