I. Objetivo y política de Derecho PUCP / Aim and policy of Derecho PUCP 

La revista Derecho PUCP publica artículos de investigación jurídica o interdisciplinaria inéditos y originales, los cuales son revisados por expertos (pares), externos, que han publicado investigaciones similares previamente. En ese sentido, no se aceptan las postulaciones de comentarios a leyes, jurisprudencia, reseñas o notas bibliográficas y otros documentos que no se correspondan con la estructura de un artículo de investigación - como, por ejemplo, ensayos, opiniones, comentarios de caso, etc.-. Las evaluaciones se realizan de forma anónima y versan sobre la calidad y validez de los argumentos expresados en los artículos. 

Para garantizar la experiencia en investigación de la persona que postula un artículo, se requerirá, como mínimo, el grado de magíster. En caso el artículo presente a más de una persona como autora, se requerirá el grado de magíster en todas las personas que figuren como autoras del artículo. 

Derecho PUCP publishes legal or interdisciplinary unpublished and original research articles, which are revised by external peers who have previously published similar researches. In this sense, we do not accept submissions of comments to laws, jurisprudence, reviews or bibliographic notes and other documents that do not correspond to the structure of a research article - e.g. essays, opinions, case comments, etc.-. The evaluations are made anonymously and are about the quality and the validity of the arguments showed on the articles. 

To guarantee the research experience of the person submitting an article, a minimum of a master's degree is required. In case the article presents more than one person as author, a master's degree will be required for all the persons who appear as authors of the article. 

II. Ética en publicación / Ethics publication

En caso sea detectada alguna falta contra la ética en publicación durante el proceso de revisión o después de la publicación del artículo, la revista tomará las acciones legales que correspondan para sancionar al autor del fraude.

In case of being detected a fault against the ethics academic publication during or after the process of revision of the publication of the article, the journal will behave according to the correspondent ethics publication international regulations and will take the corresponding legal action to penalize the author of the fraud.

III. Forma y preparación de los artículos / Form and Preparation of the articles

III.1. Normas generales / General regulations

Todo artículo presentado a la revista Derecho PUCP debe ser escrito en español o inglés, versar sobre temas de interés jurídico o interdisciplinario y tener la condición de original e inédito. El grado mínimo que se requiere de las personas que postulen un artículo será el de magíster. En el caso de los artículos que sean postulados en coautoría, se requerirá el grado de magíster a todas las personas que figuren como coautoras. La revista cuenta con las siguientes categorías o secciones ordinarias, todas arbitradas:

  • Tema central (o especial temático)
  • Miscelánea
  • Interdisciplinaria

All the articles given to Derecho PUCP have to be written in Spanish, English, or Italian, deal with topics of legal or interdisciplinary interest and have the status of original and unpublished. The minimum degree required of persons submitting a paper is a master's degree. In the case of co-authored articles, a master's degree will be required for all co-authors. The journal has the following categories or ordinary sections, all refereed:

  • Main subject (or specialized subject)
  • Miscellaneous
  • Interdisciplinary

III.2. Documentación obligatoria / Necessary documents

− Declaración de autoría y autorización de publicación. Debe ser firmada por todos los autores y enviada junto con el artículo postulante. Con este documento, el autor se compromete, entre otras, a no presentar el artículo objeto de postulación a otra revista, libro o cualquier otro medio o plataforma de difusión, hasta recibir la decisión editorial de Derecho PUCP.

 Affidavit of authorship and authorization for publication. It must be signed by all the authors and sent with the applicant article. With this document, the author commits, among other things, not to submit the article to another journal, book or any other media or platform for diffusion, until the editorial decision of Derecho PUCP is received.

III.3. Características de los artículos / Characteristics of the articles

III.3.1. Primera página / First page

En la primera página se debe incluir lo siguiente:

  • TÍTULO: en el idioma original del artículo e inglés, un título corto de hasta 60 caracteres;
  • NOMBRE DEL AUTOR (o autores): se debe incluir en una nota a pie de página la filiación institucional, ciudad y país, profesión y grado académico, así como el correo electrónico del autor y su código ORCID;
  • RESUMEN (Abstract): texto breve en el idioma original del artículo e inglés en el que se mencione las ideas más importantes de la investigación (entre doscientas y cuatrocientas palabras);
  • CONTENIDO: se consignará en el idioma original del artículo e inglés la sumilla de capítulos y subcapítulos que son parte del artículo;
  • PALABRAS CLAVE (key words): en el idioma original del artículo e inglés (mínimo 5, máximo 10).
  • En caso el estudio haya sido presentado como resumen a un congreso o tenga algún antecedente, ello debe ser precisado con la cita correspondiente.

It has to include:

  • TITLE: in the original language of the article and in English, a short title no more than 60 characters.
  • AUTHOR’S NAME (or coauthors): On a footnote has to be included the institutional affiliation, the city and the country, the profession and the academic degree, and also the e-mail, and the ORCID code.
  • ABSTRACT: short text in the original language of the article and in English where are showed the most important research ideas (among 200 and 400 words).
  • CONTENT: It is recorded in the original language of the article and in English, the summary of the chapters and sub-chapters that are part of the article.
  • KEY WORDS: in the original language of the article and in English (minimum 5, maximum 10)
  • If the study has been presented as a summary to a congress or have any antecedents, it has to be specified with the corresponding citation.

III.3.2. Cuerpo del texto / Article format

Deben atenderse los siguientes aspectos:

  • El texto deberá oscilar entre las 7 000 a 15 000 palabras, a un espacio, en letra Arial 12, en formato A4, con márgenes de 3 cm. Las excepciones a esta regla deben estar debidamente justificadas y ser autorizadas previamente por el editor general;
  • Consignar las citas a pie de página, escritas a doble espacio en letra Arial 10;
  • Los textos deberán ser redactados en el programa Word;
  • Las figuras que se pueden usar son gráficos y tablas;
  • Las referencias bibliográficas serán únicamente las que han sido citadas en el texto, y se ordenarán alfabéticamente.

Some aspects have to be taken into account:

  • The text must fluctuate among 7 000 to 15 000 words, size 12, Arial, one-spaced lines, A4 format, with 3 cms margins. The exceptions to this regulation have to be properly justified and be previously authorized by the general editor.
  • Record the footnotes. Size 10, Arial; double-spaced lines.
  • Use MS Word program to write the texts.
  • Graphics and tables can be used.
  • The bibliographic references will only be those mentioned in the text and will be correlatively organized alphabetically.

III.3.3 Normas sobre referencias bibliográficas / Bibliographic footnotes

Las referencias bibliográficas que se hagan en el artículo deben ser actualizadas, relevantes, elaboradas con la información necesaria, sin omitir alguna referencia relevante para el estudio y cumpliendo escrupulosamente con las normas de la ética académica.

Dichas referencias deben realizarse conforme a las normas del Estilo APA (American Psychological Association) recogidas en la séptima edición del Manual de Estilo APA.

Por ello, las citas bibliográficas deben realizarse en el texto, indicando entre paréntesis el apellido del autor o institución, el año de la publicación y la(s) página(s) correspondiente(s); por ejemplo: (Rubio, 1999, p. 120). También deben citarse en el cuerpo del texto las normas jurídicas, las resoluciones de toda clase de organización y las sentencias judiciales, colocando entre paréntesis las referencias correspondientes del modo en que se indica más abajo. Las referencias parentéticas en el cuerpo del texto deben remitir a la lista de referencias situada al final del documento. En dicha lista deberá aparecer la información completa de cada fuente citada en el cuerpo del texto. Sin agotar todo lo señalado en las referidas normas de estilo APA, se presenta, a continuación, una reseña de las principales indicaciones en torno a las referencias bibliográficas.

The bibliographic footnotes have to be updated, important, elaborated with the necessary information, without omitting any relevant reference to the study and fulfilling all the regulations of the academic ethics.

These references must be according to the APA Style (The American Psychological Association) gathered on the 7th edition of the APA Publication Manual.

That’s why the bibliographic footnotes have to be made in the text, indicating between parentheses the author’s last name, or institution, the year of publication, and the corresponding page (es); for example: (Rubio, 1999, p. 120). And also it has to be quoted in the body text the legal regulations, the resolutions of all kind of organizations and the legal sentences, putting in parentheses the corresponding references as it is indicated below. The parenthetical references on the body text have to send us to the list of references located at the end of the document. In that list has to appear the complete information of each source quoted on the body text. Without exhausting all the indicated in the mentioned APA style sheet, a review of the main indications about the bibliographic references appears hereunder.

III.3.3.1 Referencias en el cuerpo del texto / References in the text body

III.3.3.1.1 Citas textuales / Textual quotations

En el caso de las citas textuales, estas irán incorporadas al texto de no exceder las 40 palabras y deberán colocarse entre comillas españolas (« »). En caso la cita textual tenga una extensión de 40 palabras o más, esta deberá aparecer en un nuevo párrafo, sin entrecomillado y sangrada. Si dicha cita tiene más de un párrafo, todo nuevo párrafo a partir del segundo deberá empezar con una sangría adicional en el primer renglón. Cabe recalcar, como se señaló en el criterio de originalidad del artículo, que debe evitarse el uso de citas secundarias y terciarias, como también considerar que las citas textuales no deben superar la cuarta parte del artículo.

In the case of the textual quotations, these will be incorporated to the text, if they do not exceed the forty words, and must be placed in single quotations (« »). In the case the textual quotation has an extension of forty words or more, this must appear on a new paragraph, without quotation marks and indented. If that quote has more than one paragraph, every new paragraph, starting from the second, must begin with an additional indented on the first row. It should be stressed, as it was stated on the originality article criterion, that it should be avoided the use of secondary and tertiary quotations, and also consider that the textual quotations should not exceed the fourth part of the article.

III.3.3.1.2 Paráfrasis / Paraphrases

En el caso de citas no textuales, estas se realizarán tal como las citas textuales, indicando las páginas que el autor está resumiendo con sus propias palabras, con la diferencia de que no se utilizará comillas. Cabe resaltar que no se aceptarán paráfrasis que hacen variaciones ínfimas con relación al texto citado, solo con el fin de no emplear comillas. Esto se considera una modalidad de plagio.

In the case of no textual quotations, these will be done as the textual quotations, indicating the pages that the author is summarizing with his own words, with the only difference that quotations marks are not used. It is also remarkable that paraphrases that make minimum changes related to the text stated will not be accepted, only with the purpose of not using quotation marks. This is considered a plagiarism modality.

III.3.3.1.3 Referencia a más de una obra en una misma cita / Reference to more than one book in the same quote

De citarse más de una obra en una misma referencia, la separación entre tales obras se realizará por medio de un punto y coma, por ejemplo: (García Cavero, 2014a, p. 62; Hurtado Pozo, 2015, p. 212). Las obras deberán ordenarse alfabéticamente. En el caso de ser obras distintas, pero de un mismo autor, se realizará la separación con una coma, sin necesidad de repetir el apellido del autor, por ejemplo: (Freud, 1949, pp. 115-116, 1964, p. 212). En este último caso, las obras deberán ordenarse ascendentemente según su fecha de publicación.

If more than one book in the same reference has been cited, the separation between these books will be done by a semicolon, for example: (García Cavero, 2014a, p. 62; Hurtado Pozo, 2015, p. 212). The books must be put in alphabetical order. In the case of being different books, but from the same author, the separation will be done by a comma, without repeating the author’s last name, for example: (Freud, 1949, pp. 115-116, 1964, p. 212). In this last case, the books must be put upwards according to their publication date.

III.3.3.1.4 Citación de obras en coautoría / Citation of books in joint authorship

Cuando se desee citar una obra redactada en coautoría, los apellidos se unirán con el símbolo «&», por ejemplo: (Cicchetti & Cohen, 1995, p. 6). Asimismo, si una fuente tiene entre tres y cinco autores, se debe indicar los apellidos de todos los autores solo la primera vez que se la cita. En las siguientes ocasiones, deberá aparecer solo el apellido del primer autor, seguido de «et al.». Cuando la fuente tenga seis autores o más, solo se indicará, desde la primera vez, el apellido del primer autor seguido de «et al.». Es necesario que aparezca la información completa de todos los autores en la lista de referencias.

When you want to cite a written book in joint authorship, the last names will be joined with the symbol «&», for example: (Cicchetti & Cohen, 1995, p. 6). Likewise, if a source has among three and five authors, all the authors’ last names must be indicated only the first time that it is cited. In the following occasions, only the first author’s last name must appear, followed by «et al.». When the source has six authors or more, only the first author’s last name will be indicated, from the first time, followed by «et al.». It is necessary to appear the complete information of all the authors in the reference list.

III.3.3.1.5 Fuentes sin autor o sin año de publicación / Sources without author or without publication year

Si el texto citado no consigna nombre de autor, se indicará las primeras palabras que figuran en la entrada en la lista de referencias, usualmente el título, seguidas, tras una coma, del año de publicación; por ejemplo: («Carlos Basombrío dispone cambios», 2017). Por otra parte, si la fuente carece de año de publicación, se colocará la abreviatura «s.f.». En caso la obra se encuentre en proceso de ser publicada, se colocará la indicación «en prensa».

If the cited text does not consign the author name, the first words that appear in the entry in the reference list will be indicated, usually the title, followed, after a comma, of the year of publication; for example: («Carlos Basombrío dispone cambios», 2017). Besides that, if the source does not have year of publication, the abbreviation «n.s.». In the case the book is in process of being published, the indication «in press» will be placed.

III.3.3.1.6 Obras clásicas / Classical books

Cuando se cite un texto antiguo o clásico, cuyo año de publicación es desconocido, deberá indicarse el año de la traducción o versión empleada. En el primer caso se incluirá la abreviatura «trad.» antes del año; en el segundo caso, la palabra «versión» tras el año; por ejemplo: (Aristóteles, trad. 1931). En caso resulte relevante indicar el año original de publicación, este debe incluirse en la referencia junto al año de la edición a la que se hace referencia, separando ambos años con una barra «/»; por ejemplo: (James, 1890/1983).

When an old or classical text is cited, whose year of publication is unknown, the year of translation, or employed version must be indicated. In the first case, the abbreviation «trad.» before the year; in the second case, the word «version» after the year; for example: Aristóteles, trad. 1931) will be included. In case it is relevant to indicate the original publication year, this must be included in the reference next to the edition year being referred, separating both years with a slash «/»; for example: (James, 1890/1983).

III.3.3.1.7 Omisión de autor en citas / Author’s omission in quotes

Cuando el nombre del autor sea mencionado en el cuerpo del texto inmediatamente antes de insertar la cita, ya no será necesario incluir su nombre en la referencia parentética. Así, solo se indicará el año y, eventualmente, la(s) página(s) citada(s).

When the author’s name is mentioned in the text body immediately before inserting the quote, it will not be necessary to include his name in the parenthetical reference. Like this, only the year will be indicated and, eventually the cited page(s).

III.3.3.1.8 Citas de obras donde coinciden autor y año / Quotes of books where author and year coincide

Si hay coincidencia de autor y año entre dos fuentes citadas, se identifica la referencia mediante letra minúscula. Dicha indicación deberá figurar también en la lista de referencias. Tómese por ejemplo: (Baheti, 2001a).

If author and year coincide between two cited sources, the reference is identified by small letter. This indication must also appear in the reference list. Take this example: (Baheti, 2001a).

III.3.3.1.9 Resoluciones, acuerdos y otros documentos legales / Decisions, agreements, and other legal documents

Se deberá colocar las primeras palabras del nombre del documento, en correspondencia con la entrada respectiva en la lista de referencias, seguidas del año de publicación. Por ejemplo: (Informe de la Relatora Especial sobre la Trata, 2009).

The first words of the document name will be placed, in accordance with the respective entry in the reference list, followed by the publication year. For example: (Informe de la Relatora Especial sobre la Trata, 2009).

III.3.3.1.10 Jurisprudencia / Case law

Se indicará en el cuerpo del texto el nombre abreviado del caso (en cursivas) y el año de la sentencia. Por ejemplo: (Centro de Estudios c. Ministerio de Energía, 2016).

In the text body will be indicated the abbreviated name case (in italics), and the sentence year. For example: (Centro de Estudios c. Ministerio de Energía, 2016).

III.3.3.1.11 Normativa y legislación / Rules and Legislation

Se indicará el nombre oficial y/o más usual de la norma, en correspondencia con la entrada respectiva en la lista de referencias, seguido del año de promulgación. Por ejemplo: (Ley contra la Trata de Personas, 2007).

The official and /or the most useful name of the regulation will be indicated in accordance with the respective entry in the reference list, followed by the promulgation year. For example: (Ley contra la Trata de Personas, 2007).

III.3.3.2 Lista de referencias / Reference list

Al final del documento, se consignará toda fuente citada en el texto: libro, capítulo de libro, artículo de revista, libro clásico traducido, artículo de una publicación seriada, tesis no publicadas, artículos en un libro de referencia, contenido de Internet, documentos legales, jurisprudencia o normativa. La lista de referencias solo debe incluir las fuentes a las que se hace referencia en el texto. No debe incluirse en dicha lista obras consultadas adicionalmente que no hayan sido mencionadas en el cuerpo del texto. A continuación se presentan algunos ejemplos para los distintos tipos de fuentes.

At the end of the document, every cited source in the text will be consigned: book, chapter of the book, journal article, translated classical book, article of a serial publication, unpublished theses, articles in a reference book, Internet content, legal documents, case law or legislation. The reference list should only include the sources being referred to in the text. Additional books consulted should not be included in this list if they had not been mentioned in the text body. Some examples for the different sources types are listed below.

III.3.3.2.1 Libro / Book

Tendrá la siguiente estructura: Autor, A. A. (año). Título (número de edición, si es distinta de la primera, o cualquier otra información adicional sobre la edición). Ciudad: Editorial.

Ejemplo:

Chaumon, F. (2004). La ley, el sujeto y el goce (V. Ackerman, trad.). Buenos Aires: Nueva Visión.

It will have the following structure: Author, A.A. (year). Title (edition number, if it is different from the first one, or any other additional information about the edition). City: Publisher.

Example:

III.3.3.2.2 Capítulo de libro / Book chapter

Tendrá la siguiente estructura: Autor, A. A. (año). Título del capítulo. En E. Editor (Ed.), Título del libro (páginas del capítulo). Ciudad: Editorial.

Ejemplo:

Sameroff, A. J., & Fiese, B. H. (2000). Models of development and developmental risk. En C. H. Zeanah (Ed.), Handbook of infant mental health (2.a ed., pp. 3-19). Nueva York: Guilford Press.

It will have the following structure: Author, A. A. (year). Title of the chapter. In P. Publisher (Pub.), Book title (chapter pages). City: Publisher.

III.3.3.2.3 Instituciones como autores / Institutions as authors

Tendrá la siguiente estructura: Nombre completo del grupo o de la institución (año). Título (número del documento, en caso lo tenga). Ciudad: Editorial/Recuperado de URL.

Ejemplo:

III.3.3.2.4 Obra clásica reeditada / Republished classical book

En caso se considere relevante indicar el año original de publicación, la entrada en la lista de referencias tendrá la siguiente estructura: Autor, A. (año de la traducción o versión citada). Título del capítulo (datos adicionales de edición). En E. Editor (Ed.), Título del libro (páginas del capítulo). Ciudad: Editorial. (Reedición de Título de la edición original, páginas del capítulo, por E. Editor, Ed., año de publicación original, Ciudad: Editorial).

Ejemplo:

Piaget, J. (1988). Extracts from Piaget’s theory (G. Gellerier & J. Langer, trads.). En K. Richardson & S. Sheldon (Eds.), Cognitive development to adolescence: A reader (pp. 3-18). In the case it is considered relevant to indicate the original year of publication, the entry in the reference list will have the following structure: Author, A. (year of translation or cited version). Title of the chapter (additional edition information). In P. Publisher (Pub.), Book title (chapter pages). City: Publisher. (Reedition of the original edition title, chapter pages, by P. Publisher, Pub., original publication year, City: Publisher).

Example:

III.3.3.2.5 Artículo en publicación seriada / Article in serial publication

Tendrá la siguiente estructura: Autor, A. (año). Título del artículo. Título de la revista, diario o semanario, Volumen(número), páginas. https://doi.org/xxx.xxxxx. Debe tratarse que todos los artículos incluyan su código DOI o una URL permanente; no se colocará punto final tras este dato.

Ejemplo:

Stone, G. R. (2003). Civil liberties in wartime. Journal of Supreme Court History, 28(3), 215-251. https://doi.org/10.1111/1540-5818.00065

It will have the following structure: Author, A. (year). Title of the article. Title of the daily or weekly magazine, Volume (number), pages. https://doi.org/xxx.xxxxx. It should be considered that all the articles include its code DOI or a permanent URL; final point will not be placed after this information.

III.3.3.2.6 Fuentes de Internet / Internet sources

Tendrá la siguiente estructura: Autor, A. (año). Título. Recuperado de Nombre del sitio web: URL.

III.3.3.2.7 Tesis no publicada / Unpublished thesis

Tendrá la siguiente estructura: Autor, A. (año). Título (Tesis inédita de grado obtenido). Universidad o Institución, Lugar. Si la tesis se encuentra disponible en una base de datos, indicar los datos relevantes entre paréntesis al final de la referencia.

Ejemplo:

Sánchez Montenegro, J.P. (2011). Las Fuerzas Armadas y el estado de emergencia como instrumento de su recuperación institucional durante el período 2001-2010 (Tesis inédita de Licenciatura en Ciencia Política). Pontificia Universidad Católica del Perú, Lima.

It will have the following structure: Author, A. (año). Title (unpublished obtained postgraduate thesis). University or Institution, Place. If the thesis is available in a database, indicate the relevant information between parentheses at the end of the reference.

Example:

Sánchez Montenegro, J.P. (2011). Las Fuerzas Armadas y el estado de emergencia como instrumento de su recuperación institucional durante el período 2001-2010 (Tesis inédita de Licenciatura en Ciencia Política). Pontificia Universidad Católica del Perú, Lima.

III.3.3.2.8 Artículo en un libro de referencia / Article in a reference book

Tendrá la siguiente estructura: Autor, A. (año). Título del artículo o de la entrada. En E. Editor (Ed.), Título de la enciclopedia (volumen, páginas). Ciudad: Editorial. Si la entrada no tiene autor, se debe iniciar la referencia con su título.

Ejemplo:

III.3.3.2.9 Resoluciones, acuerdos y otros documentos legales / Decisions, agreements and other legal documents

Se consignará toda resolución administrativa o de una organización internacional que haya sido citada en el texto, así como acuerdos, pactos y otros documentos legales. La entrada en la lista de referencias tendrá la siguiente estructura: Nombre completo del documento, código oficial si se aplica (año).

Ejemplo:

Informe de la Relatora Especial sobre la trata de personas, especialmente mujeres y niños, Joy Ngozi Ezeilo, ante la Asamblea General de las Naciones Unidas, A/64/290 (2009).

Every administrative or from an international organization decision must be consigned that had been cited in the text, as well as agreements, pacts, and other legal documents. The entry in the reference list will have the following structure: document full name, official code if applied (year).

III.3.3.2.10 Jurisprudencia / Case law

Se consignará toda sentencia citada que provenga de una corte nacional, internacional o extranjera. Los laudos arbitrales también estarán considerados en este apartado. La entrada en la lista de referencias tendrá la siguiente estructura: Nombre del caso, referencia a la publicación o número de expediente en que se encuentra la sentencia (Tribunal y Sala si se aplica, fecha completa).

Every cited case that comes from a national, international or foreign court must be consigned. The arbitral awards will be also considered in this section. The entry in the reference list will have the following structure: Name of the case, reference to the publication, or number of file where the decision is located (Court and Court room if applied, full date).

III.3.3.2.11 Normativa y legislación / Rules and legislation

Se consignará toda norma o ley citada, ya sea nacional, internacional o foránea. Tendrá la siguiente estructura: Nombre completo de la norma, Órgano emisor, código de la norma, Boletín o equivalente en el que se publicó la norma con datos de publicación (año de promulgación).

Ejemplo:

Ley contra la Trata de Personas y el Tráfico Ilícito de Migrantes, Congreso de la República del Perú, Ley n.o 28950, Diario Oficial El Peruano (16 de enero de 2007) (2007).

Every rule or cited law will be consigned either national, international or foreign. It will have the following structure: Rule’s full name, body issuing, rule code, Bulletin or equivalent where the regulation was published with publication information (year of enactment).
