Conflicto, autotutela y control jurisdiccional

Résumé

El presente artículo desarrolla el tema de los conflictos entre individuos como parte de la dinámica social, así como los distintos modos de solución que el ordenamiento jurídico nos provee. Al respecto, la autora centra su análisis en la autodefensa, uno de esos mecanismos de solución, para luego comentar sobre algunos supuestos que aquélla encierra, como por ejemplo la legítima defensa. Finalmente, se aborda un interesante punto en cuanto a la autotutela administrativa como otra forma de resolver los conflictos, pero a partir de la intervención del Estado.

The current article develops the topic of conflicts between individuals as part of the social dynamics, and presents the different ways of solution that the legal system provides. With this in mind, the author focuses her analysis on self-defense, one of those mechanisms of solution, and then she comments two other assumptions which are included in that legal figure, for example the right to self-defense. Finally, the article points out a main aspect that is related to administrative non-judicial measures, as another way to solve conflicts, having in mind the State intervention.
