Abstract

This article examines the Final Report of the Truth and Reconciliation Commission in Peru, with a focus on legal analysis. It should be noted that this work would not have been possible without the support of a multidisciplinary perspective, which allowed the legal approach to be nourished by contributions from other disciplines. In this respect, issues such as the behaviour of institutional actors, the construction of the concept of a "systematic pattern" of human rights violations, the criteria for attribution of responsibility and proposals for reform of the judicial system were addressed. The Final Report of the CVR emphasises the need to understand the national historical context in which the violence took place and the importance of analysing the crimes and human rights violations in order to determine the political and criminal responsibility of the perpetrators. Consequently, we must not forget that the response to violence must be framed within the guidelines of a democratic regime that respects the rule of law.
