Abstract

This paper aims to study the development of arbitration in Peru, taking into account the foundations that gave rise to its emergence, the legislative advances over time and will focus on analyzing the popular arbitration that has arisen as a result of all the mentioned advances, which has given way to a new popular justice. The first part will make a brief introduction of the different conflict resolution mechanisms and the crisis through which the Peruvian official justice system goes through. After that, the emergence of arbitration in history will be analyzed and how it has been positioned both in Peruvian legislation and in society, making more extensive use. The third part develops the increasing use of arbitration as a means of conflict resolution by the State and the corresponding legislation. After that, the use of arbitration in areas considered popular is emphasized, extending the use of this mechanism of conflict resolution to the majority population together with legislation that supports it. Finally, certain conclusions are offered regarding the benefits of the use of arbitration in its different areas, which are very useful in the face of the increasing work load that the Judicial Power supports.
