Abstract

This paper develops the legal figure of duplicity of registry entries in the Land Registry or also known as overlapping of properties. Duplicity of registry entries generates a problem whose solution may ultimately require a judicial process to solve the problem of duplicity of registry entries.
It is highly probable that the duplicity of registry entries limits the legal traffic of the properties and in most cases limits the transfer agreements of the properties by punishing the sale price, by agreeing obligations under the seller´s liability or  termination clauses. Even the duplicity of registry entries may be decisive to decide not to go ahead with the transfer agreement.
That is why, in this article we will describe which are the solution mechanisms (private, administrative, or judicial) that the owner must eliminate the duplicity of registry entries.
